Terms and Conditions

1. Prize draw promotions – From time to time, Mukka Motorsport Limited (Mukka Motorsport) may make available giveaway draws to promote the sale of some or all of its products or services.

2. Acceptance of Terms and Conditions – Entry into the giveaway draws is deemed acceptance of these Terms and Conditions for Giveaway Draws, Mukka Motorsport’s Terms of Service (available here), Mukka Motorsport’s Privacy Policy (available here) and any specific terms and conditions that apply to any giveaway draw promotion, in each case as amended from time to time.

3. Prize – Mukka Motorsport will disclose [on its website] details of the prize for each giveaway draw. Any further terms associated with the prizes will be disclosed on the website.

4. Timing of draw – All entries into the giveaway draws will close at 5pm on the last day of the giveaway draw as disclosed on the website. Mukka Motorsport will randomly draw a winner for each prize within seven days of entries closing, and Mukka Motorsport will contact each winner in accordance with clause 9 below.

5. Entry –

a. Entry to giveaway draw through purchase of products and services – Each person that has spent the amount advertised on the website for the purchase of Mukka Motorsport products directly from Mukka Motorsport through Mukka Motorsport’s website during any promotion period specified on the website will receive the corresponding advertised number of entries into the giveaway draw advertised. For the avoidance of doubt, entry timeframes for any giveaway will be specified on the website.

b. Multiple entries – As a result of the terms of entry, it is acknowledged that any one person may receive more than one entry to the relevant giveaway draw.

c. Ineligibility- Directors, employees and contractors of Mukka Motorsport and their immediate family members are ineligible for entry into any giveaway draws or to receive prizes associated with giveaway draws.

6. Age – If the prize is a vehicle and the winner is under the age of 16 on the date the giveaway draw takes place, the winner and their parent or legal guardian must agree for the parent or legal guardian to take legal ownership of the vehicle. Should the winner or their parent or legal guardian not agree to this, the winner will forfeit the prize won in the giveaway draw.

7. Changes – Mukka Motorsport reserves the right to:

a. end, modify or suspend any giveaway draw promotion that cannot be run as planned for any reason;

b. provide a winner with an alternative prize if for any reason a prize becomes unavailable beyond Mukka Motorsport’s control; and

c. amend these terms and conditions from time to time or add further terms and conditions for any specific giveaway draw promotion.

Mukka Motorsport will update its website with any changes to the giveaway draw promotions or these terms and conditions, and such changes will take effect from the time the website is updated.

8. Final decision – Mukka Motorsport’s decision on all matters relating to giveaway draws is final and binding.

9. Contacting winner – Mukka Motorsport will use reasonable endeavours to contact any winner of a giveaway draw by phone or voice message. We will never provide a link to follow. If the winner cannot be contacted by Mukka Motorsport within a reasonable time, the prize will be forfeited.

10. Publicity – By accepting the prize, each winner of each giveaway draw agrees to participate in and co-operate as required with all reasonable publicity and marketing activities in the manner determined by Mukka Motorsport. Should the winner not agree to such publicity or marketing activities, the winner will forfeit the prize won in the giveaway draw.

11. No exchanges – The prize must be accepted by the winner as offered and cannot be redeemed for cash, transferred or exchanged.

12. Expenses – Unless expressly provided otherwise in the prize description, all expenses associated with winning a giveaway draw (including, without limitation, delivery and/or collection of the prize) are the winner’s responsibility.

13. Liability – Except for liability that cannot be excluded by law, Mukka Motorsport, its directors, officers, employees and contractors and any other person or entity associated with the prize or that is responsible for promoting any giveaway draw promotion will have no liability (whether in tort (including negligence), breach of contract, equity or otherwise) for any direct, indirect or consequential loss or damage arising out of or in connection with participation in any giveaway draw or the use of any prize offered.
